KIRYAS JOEL — The village of Kiryas Joel is building a water pipeline its leaders say will lessen the burden on local wells but officials from two neighboring communities are seeking to stop that.

David Gordon, a New Paltz-based attorney representing the village and town of Woodbury, sent a letter to Orange County Commissioner of Public Works (DPW) Christopher Viebrock in April, regarding a work permit on County Route 44 through the town and village for a water pipeline Kiryas Joel is working on.

Gordon contended in the letter that renewing the work permit would be illegal and contrary to county legislation governing the work permit.

The Orange County Legislature passed a resolution in 2013 requiring that pipeline work in the county be conditioned on the village obtaining authorization to utilize the water sources that the pipeline is being built for.

That means permission from New York City Department of Environmental Protection (DEP) for access to the Catskill Aqueduct in New Windsor, or a permit from the state Department of Environmental Conservation (DEC) to utilize its wellfields in Mountainville, Gordon said.

The Village of Kiryas Joel has filed a lawsuit challenging the resolution, Gordon said.

Joshua Poupore, senior vice president at Corning Communications, declined to address the lawsuit.

Poupore issued a statement on behalf of the Kiryas Joel's government which stated: 'In 2013, construction of a 6.3 mile segment of water pipeline was initiated. Prior to the end of the 2014 construction season, nearly five miles was completed (approximately 80 percent). It is anticipated that the remaining segment will be completed this summer.

'The community of Kiryas Joel looks forward to the completion of the pipeline in order ensure reliable supplies of water and to ease the burden placed on locally sourced wells.'

County's positionJustin Rodriguez, spokesman for the county executive, wrote in an emailed statement on Tuesday that: “The County has asked the Center for Governmental Research to study the potential impact of a proposed 507-acre annexation by Kiryas Joel and to analyze whether the expansion plans require the Village to redo its environmental review for the water project.

'When the review is complete, a decision will be made,' the statement continued. 'The original pipeline permit was sought before the annexation.

'Now that the annexation application exists, we have to take into account the 'worst case scenario' as we protect our roads. We want to ensure that if Monroe and Kiryas Joel grant the annexation (and under State Law it is solely their choice to approve it or not), that the Village doesn’t turn around and ask to rip open our roadsides and disrupt traffic again. ”

According to Jomo Miller with the DEC's Office of Media Relations, the application by the village to utilize the Mountainville wellfield water supply remains suspended while the DEC awaits the village's response to comments made at a 2014 hearing regarding the project.

Gordon called it 'a pipeline to nowhere, for which the Legislature has forbidden disrupting the county roads until there is need for the project.'

He contended the county's DPW has 'neither legal authority nor a rational basis for authorizing further work on the pipeline in the County rights of way,' pending Kiryas Joel’s obtaining either permission from New York City to access the Catskill Aqueduct or from state to utilize the wellfield in Mountainville.

Last month, Caruso and Queenan wrote letters to Neuhaus in which they wrote: 'There is no benefit to anyone in allowing County roads to be disrupted to construct a water pipeline for which there is no water source.'
